Recently in the state of Arizona, a woman sued Wal-Mart for firing her after she tested positive for medical marijuana. February 2019 brought about an order on the case from a United States District Court. While the order was decided on the facts of the case, it was also influenced by the legal strategies employed by the lawyers. This article will parse out some of the conclusions and takeaways from that order. The employer won on two issues, but ultimately was found to have violated Arizona’s Medical Marijuana Act by firing the employee for medical marijuana use.
